Statutory Rape / Child Molestation
Three basic categories: Rape, Sodomy and Sexual Assault:
- Rape in the first degree if a person 16+ years old has intercourse with person of opposite sex under 12 years old. (Class A felony)
- Rape in second degree if person 16+ has intercourse with person of opposite sex 12 to 15 years old. (Class B felony)
- Sodomy in the first degree if a person 16+ years old has anal or oral sex with a person under 12 years old. (Class A felony)
- Sodomy in second degree if person 16+ has anal or oral sex with a person 12 to 15 years old. (Class B felony)
- Sexual abuse in the first degree if person 16+ has any sexual contact with a person under 12 years old. (Class C felony)
- Sexual abuse in the second degree if person 19+ has any sexual contact with a person under 16 but over 12 years old. (Class A misdemeanor)
