Alaska Statutory Rape & Child Molestation

Sexual abuse of a minor, first, second, third and fourth degree:

  • Sexual abuse of a minor in first degree person 16+ years old has sexual penetration with a person under 13 years of age; or, person 18+ years old has sexual penetration with person under 18 where defendant is the victims parent or legal guardian; or, person 18+ years old has sexual penetration with person under 16 where defendant lives in same house as victim and has authority over victim or holds a position of authority related to victim. (unclassified felony)
  • Sexual abuse of a minor in second degree person 16+ years old has sexual penetration with person 13, 14 or 15 years old and who is at least 3 years younger than the offender; or, person 16+ has sexual contact with person under 13 years old; or person 18+ has sexual contact with person under 18 where defendant is parent or guardian; or, person 18+ has sexual contact with person under 16 and defendant lives in same house as victim and has authority over victim or holds a position of authority related to victim . (Class B felony)
  • Sexual abuse of a minor in third degree person 16+ years old has sexual contact with person 13, 14 or 15 years old and who is at least 3 years younger than the offender; or, person 18+ has sexual penetration with person 16 or 17 and who is at least 3 years younger than the offender and defendant holds a position of authority related to victim; or, person under16 has sexual penetration with person under 13 and at least 3 years younger than defendant. (Class C felony)
  • Sexual abuse of a minor in fourth degree person under16 years old has sexual contact with person under13 and who is at least 3 years younger than the offender; or, person 18+ has sexual contact with person 16 or 17 and who is at least 3 years younger than the offender and defendant holds a position of authority related to victim. (Class A misdemeanor.)
  • Affirmative Defenses If consensual and legally married to victim, or where defendant reasonably believed the victim to of legal age and undertook reasonable measures to verify that victim was that age or older.
