Statutory Rape & Child Molestation in Arizona
- 13-1405 Sexual Conduct with a minor Any person has sexual penetration or oral sex with a person under 18 years of age; if victim is under 15 years old, Class 2 Felony; if victim is 15, 16 or 17, Class 6 Felony.
- 13-1410 Molestation of a Child Any person has sexual contact with a person under 15 years of age except where the contact involves only the female breast. (Class 2 Felony).
- 13-1404 Sexual Abuse Any person has sexual contact with a person 15 years of age or older without consent, (Class 5 Felony); or with victim under 15 and the contact involves only the female breast. (Class 3 Felony).
- 13-1403 Public Sexual Indecency to a minor Any person engages in a sexual act with reckless disregard for the presence of a person under 15 years old.. (Class 5 Felony).
- Affirmative Defenses As to 13-1405 and 13-1404, if consensual and victim is 15, 16 or 17 then reasonable mistake as to age is a defense. Defense to 13-1405 if consensual and victim is 15 or older and defendant is under 19 or attending high school and no more than 24 months older than victim.
