Sex Crimes Involving Victims that are Minors
Statutory Rape & Child Molestation in Arkansas
- Rape: person has sexual intercourse with a person under 14 years of age and defendant is more than 3 years older than victim; or, person has sexual penetration with person under 18 where defendant is more than 3 years older than victim and defendant is the victims parent or legal guardian, uncle, aunt, grandparent, brother, sister (whole, half or by adoption), nephew, niece, or first cousin. (class Y felony)
- Sexual Assault in First Degree: person has sexual penetration or oral sex with person under 18 where defendant is in any of the enumerated positions of trust by employment ( 5-14-124). (Class A felony)
- Sexual Assault in Second Degree: person 18+ years old has sexual contact with person under 14; or, sexual contact with person under 18 and defendant has position of authority; or, person under 18 has sexual contact with a person under 14 where defendant is 3+ years older than a victim under 12; or, teacher in grades K-12 has sexual contact with person 21 years old and is a student where defendant is employed. (Class B felony)
- Sexual Assault in Third Degree: person 20+ has sexual penetration or oral sex with person under 16; or, person 20+ has sexual contact with person under16 and who is at least 3 years younger than the offender. (Class C felony)
- Sexual Assault in Fourth Degree: person 20+ has sexual contact with person under 16. (Class D felony)
- Sexual Indecency with a Child: person 18+ solicits a person under 15, or who is represented to be under 15, to engage in sexual contact; or, with intent to arouse person purposefully exposes his or her sex organs to a person under 15 where defendant is more than 3 years older than the victim; or, person 18+ with intent to arouse causes or coerces a person under 14 to exposes sex organs or breasts. (Class D felony)
