Sex Crimes Involving Victims that are Minors
Statutory Rape / Child Molestation
- 269 Aggravated Sexual Abuse of a Child: Any person who, by use of force, engages in sexual intercourse, sexual penetration, sodomy, or oral sex with any person under 14 and where defendant is 10+ years older than the victim. (Felony, punishable by 15 years to life).
- 289 Sexual Penetration: Any person who engages in sexual penetration, using a foreign object or any body part other than the sex organ, with any person under 14 and where defendant is 10+ years older than victim (Felony, punishable by 3, 6, or 8 years); or, any person who engages in sexual penetration, using a foreign object or any body part other than the sex organ where victim is 14 or 15 years old (Felony); or, any person who engages in sexual penetration, using a foreign object or any body part other than the sex organ where victim is 16 or 17 years old (Felony or misdemeanor, depending upon discretion of prosecutor, punishable by one year of county jail or 16 months, or 2 or 3 years in state prison).
- 288 Lewd Act on Child: Any person who commits a lewd act with the intent to arouse with a person under 14 (Felony, punishable by 3, 6, or 8 years); or, any person who commits a lewd act with the intent to arouse with a person 14 or 15 and where defendant is 10+ years older than victim (Felony or misdemeanor).
- 286 Sodomy with Child: Any person who engages in sodomy with a person under 14 and where defendant is 10+ years older than victim (Felony, punishable by 3, 6, or 8 years); or, any person 21+ who engages in sodomy with a person under 16 (Felony); or, any person who engages in sodomy with any person under 18 (Felony or misdemeanor).
- 288a Oral Sex with Child: Any person who engages in oral sex with a person under 14 and where defendant is 10+ years older than victim (Felony, punishable by 3, 6, or 8 years); or, any person 21+ who engages in oral sex with a person under 16 (Felony); or, any person who engages in oral sex with any person under 18 (Felony or misdemeanor).
- 261.5 Unlawful Sexual Intercourse: Any person 21+ who engages in sexual intercourse with a person under 16 (Felony or misdemeanor); or, any person who engages in sexual intercourse with any person under 18 and where defendant is more than 3 years older than victim (Felony or misdemeanor); or, any person who engages in sexual intercourse with any person under 18 and where defendant is not more than 3 years older than victim. (Misdemeanor).
