Juvenile Court Jurisdiction

Generally, Jurisdiction over persons 10 to 18 when before the court. Jurisdiction can be retained until defendant has completed all orders, cases, etc., regardless of defendants age.

May Direct File in Adult Court:

  • Where juvenile is 14+ and charged with a Class 1 or 2 felony.
  • Where juvenile is 14+ and charged with a serious felony listed in 19-2-517
    (1)(a)(II)(A)-(D).
  • Where juvenile has, within last 2 years, been adjudicated a delinquent for committing a crime listed in 19-2-517 (1)(a)(III).
  • Where juvenile is 14+ and charged with a felony and has previously been charged in adult court.

Prosecutor May Move for Transfer:

  • Where juvenile is 12-13 and accused of a class 1 or 2 felony or crime of violence.
  • Where juvenile is 14+ and accused of any felony.
