DELAWARE JUVENILE COURT ATTORNEY
Juvenile Court Jurisdiction
Prosecutor may move to transfer case of any juvenile where:
- Juvenile is charged with first or second degree murder, first or second degree rape, first degree assault, first degree robbery, or first degree kidnapping. If court finds probable cause as to any of these charges, it must transfer the case.
- Juvenile 14+ is deemed not amenable to juvenile rehabilitation.
- Juvenile is 16+ and has been adjudicated delinquent 1 or more times on a felony charge and current charge is one listed in 10 Del. C. 1010 (a)(3)
