Sex Crimes Involving Victims that are Minors
Statutory Rape & Child Molestation in Delaware
- Rape, First Degree: person 18+ has sexual intercourse with a person under 12 years of age; or, person has sexual intercourse with person under 16 where defendant holds a position of authority over victim. (Class A felony)
- Rape, Second Degree: person has sexual penetration or oral sex with person under 16 and defendant causes serious bodily injury or displays a weapon; or, defendant is 18+ and victim is under 12; or, where defendant holds a position of authority over victim who is under 16. (Class B felony)
- Rape, Third Degree: person has intercourse with person under 16 and defendant is 10+ years older than victim; or, the victim is under 14 and defendant is 19+. (Class B felony)
- Rape, Fourth Degree: person has intercourse with person under 16; or, person 30+ years old has intercourse with person under 18; or, person has sexual penetration or oral sex with a person under 16; or, person has intercourse, sexual penetration or oral sex with person is under 18 and where defendant holds a position of authority over victim. (Class C felony)
- Unlawful Sexual Contact, First Degree: person has any sexual contact with a person under 16 and causes physical injury to victim, or displays or claims to have a weapon. (Class F felony)
- Unlawful Sexual Contact, Second Degree: person has any sexual contact with a person under 16. (Class G felony)
