Juvenile Court Jurisdiction

Generally, Jurisdiction over persons under 18 when alleged crime committed.

State may file in adult court where juvenile is 13 to 17 at time of offense and is charged with a serious felony specified in 15-11-28 (b)(2)(A) and juvenile is currently charged with a violent crime against a person.

Court may transfer case to adult court where:

  • Any Juvenile who is 15+ at time of offense who committed a designated felony.
  • Juvenile who is 13 or 14 at time of offense and has been charged with a crime punishable by life confinement or committed aggravated battery resulting in serious bodily injury.
