IDAHO CRIMINAL EXPUNGEMENT ATTORNEY
Idaho Code 19-2604
Upon application by defendant and a showing that defendant has complied with all terms of probation, if the sentence has been suspended or withheld, the court may dismiss the case and discharge defendant, restoring defendants civil rights.
-This statute has been construed to be a statutory partial expungement, creating a special procedure whereby a successful probationer who has been convicted of a felony can request the district court to amend the judgment so that the harsh consequences of a felony conviction can be avoided. Housley v. State, 811 P.2d 495 (Id. Ct. App. 1991).
