Juvenile Court Jurisdiction
Generally, Jurisdiction over persons under 21 who are alleged to have committed a crime when under 18.
No juvenile court jurisdiction where:
- Juvenile is 16+ and charged with crime listed in 31-30-1-4.
- Any juvenile previously placed under jurisdiction of adult court.
Upon motion by prosecutor Court may transfer case to adult court:
- Mandatory transfer of juvenile 10+ at time of offense and probable cause that juvenile committed murder.
- Mandatory transfer of any juvenile charged with felony and previously convicted of a felony or nontraffic misdemeanor.
- Mandatory transfer of juvenile 16+ at time of offense and probable cause that juvenile committed a felony listed in 31-30-3-5.
- Discretionary transfer of juvenile 14+ at time of offense and probable cause that juvenile committed a felony listed in 31-30-3-2 or 31-30-3-3.
