Juvenile Court Jurisdiction
Jurisdiction over persons under 18 when alleged crime was committed; Juvenile Court can retain jurisdiction until defendant turns 23.
No juvenile jurisdiction over miner who has previously been convicted or sentenced as an adult.
Prosecutor may request transfer of any juvenile to adult court. Generally, presumption against transfer, burden on prosecution to show good cause for transfer.
Prosecutor may request transfer of any Juvenile who was 14, 15, 16 or 17 at time of the offense and who is charged with any of the serious felonies listed in 38-1636(a)(2) (attached hereto), here presumption is that juvenile should be prosecuted as an adult, burden on juvenile to rebut presumption.
Factors for court to consider on motion for transfer are set forth in 38-1636 (e).
