Statutory Rape & Child Molestation in Kentucky
- 510.040 Rape in first degree Any person who has sexual intercourse with a person under 12 years of age. (Class A felony)
- 510.050 Rape in second degree A person 18+ who has sexual intercourse with a person under 14 years of age. (Class C felony)
- 510.060 Rape in third degree A person 21+ who has sexual intercourse with a person under 16 years of age or under 18 where defendant is a foster parent of victim. (Class D felony)
- 510.070 Sodomy in first degree Any person who has sodomy with a person under 12 years of age. (Class A felony)
- 510.080 Sodomy in second degree A person 18+ who has sodomy with a person under 14 years of age. (Class C felony)
- 510.090 Sodomy in third degree A person 21+ who has sexual intercourse with a person under 16 years of age, or under 18 where defendant is a foster parent of victim. (Class D felony)
- 510.110 Sexual abuse in first degree Any person who has sexual contact with a person under 12 years of age. (Class D felony)
- 510.120 Sexual abuse in second degree Any person who has sexual contact with a person under 14 years of age. (Class A misdemeanor)
- 510.120 Sexual abuse in third degree Any person who has sexual contact with a person under 16 and at least 14 years of age and defendant is 5 or more years older than the victim. (Class B misdemeanor)
- Affirmative Defenses Under 510.030 it is a defense that defendant did not know that victim was under 16.
