Juvenile Court Jurisdiction
Jurisdiction over persons under 18 years old when crime was committed. ( 3101).
Prosecution may move to transfer the case of any juvenile charged with murder or any Class A, B or C crime to adult court; the court must hold a hearing on the motion. ( 3101(4)(A). Court must consider factors set forth in 3101(D)(1)-(4), and shall transfer the case to adult court if factors listed in 3101(E)(1)-(2) are deemed true. Note that the burden of proof as to the appropriateness of juvenile proceedings rests with the state unless the juvenile is charged with a serious violent felony listed in 3101 C-2, the burden then shifts to the juvenile.
