However, in October 2009, the U.S. Justice Department issued a memo to certain U.S. attorneys, outlining its policy for marijuana arrests. According to the memo, the federal government has taken its focus away from going after ill patients and caregivers who grow and smoke marijuana to treat a medical condition.

The memo stated that the department plans to focus its efforts on arresting big-time offenders such as drug traffickers. While some medical marijuana advocates celebrated this advancement in the law, some local officials say they still plan to go after dispensaries in their cities. For instance, the Sheriff of Kern County, California reported that he still plans on going after California cannabis dispensaries that are growing and selling marijuana for profit. Non-profit dispensaries will be left alone.
