Statutory Rape & Child Molestation
- 3-304 Rape in the second Degree Any person has vaginal intercourse with a person under 14 years of age and where defendant is at least 4 years older than victim. (Felony punishable up to 20 years)
- 3-306 Sexual Offense in the second Degree Any person who engages in a sexual act with a person under 14 years of age and where defendant is at least 4 years older than victim. (Felony punishable up to 20 years)
- 3-306 Sexual Offense in the third Degree Any person who engages in a sexual contact with a person under 14 years of age and where defendant is at least 4 years older than victim; or, engage in a sexual act with a person 14 or 15 years old and defendant is at least 21 years old; or; engage in vaginal intercourse with a person 14 or 15 and defendant is at least 21 years old. (Felony punishable up to 10 years)
- 3-308 Sexual Offense in the fourth Degree Any person who engages in a sexual contact with a person under 14 or 15 years of age and where defendant is at least 4 years older than victim; or, engage in a vaginal intercourse with a person 14 or 15 years old and defendant is at least 4 years older than victim. (Misdemeanor. punishable up to 1 year)
