Statutory Rape & Child Molestation in Minnesota
- 609.342 Criminal Sexual Conduct in the First Degree Any person who has sexual penetration or sexual contact with a person under 13 years of age where the defendant is more than 36 months older than the victim; or, where victim is at least 13 but less than 16 and the defendant is more than 48 months older than the victim and in a position of authority with respect to victim; or, the victim is under 16 and defendant has a significant relationship to the victim. (Punishable up to 30 years)
- 609.343 Criminal Sexual Conduct in the Second Degree Any person who has sexual contact with a person under 13 years of age where the defendant is more than 36 months older than the victim; or, where victim is at least 13 but less than 16 and the defendant is more than 48 months older than the victim and in a position of authority with respect to victim; or, the victim is under 16 and defendant has a significant relationship to the victim. (Punishable up to 25 years)
- 609.344 Criminal Sexual Conduct in the Third Degree Any person who has sexual penetration with a person under 13 years of age where the defendant is not more than 36 months older than the victim; or, where victim is at least 13 but less than 16 and the defendant is more than 24 months older than the victim and where defendant did not believe the victim to be 16 or older; or, the victim is at least 16 but less than 18 and the defendant is more than 48 months older than the victim and in a position of authority over the victim; or the victim is at least 16 but less than 18 and the defendant has a significant relationship with the victim and used force or coercion or the victim suffered an injury or the sexual abuse occurred on multiple occasions. (Punishable up to 15 years).
- 609.345 Criminal Sexual Conduct in the Fourth Degree Any person who has sexual contact with a person under 13 years of age where the defendant is not more than 36 months older than the victim; or, where victim is at least 13 but less than 16 and the defendant is more than 24 months older than the victim and where defendant did not believe the victim to be 16 or older; or, the victim is at least 16 but less than 18 and the defendant is more than 48 months older than the victim and in a position of authority over the victim; or the victim is at least 16 but less than 18 and the defendant has a significant relationship with the victim and used force or coercion or the victim suffered an injury or the sexual abuse occurred on multiple occasions. (Punishable up to 10 years).
- 609.345 Criminal Sexual Conduct in the Fifth Degree Any person who engages in masturbation or lewd exhibition of the genitals in the presence of a person under 16. (Punishable up to 1 year).
