Juvenile Court Jurisdiction
Jurisdiction over persons under 18 years old when crime was committed, jurisdiction can continue until defendant reached 19 years old.
Concurrent jurisdiction with adult court, permitting prosecution to direct file the case in adult court where defendant was 16 or 17 at time of an alleged non-traffic misdemeanor or infraction; or any juvenile defendant accused of a felony. ( 43-247)
Prosecutor must consider factors set forth in 43-276 in deciding whether to file in adult court or juvenile court.
If prosecutor file the case in adult court, the juvenile has the right to file a motion and have a hearing requesting transfer to juvenile court. Court shall consider the factors set forth in 43-276 and transfer the case to juvenile court unless a sound basis exists for retaining adult court jurisdiction. ( 43-261)
