NEVADA JUVENILE COURT ATTORNEY

Juvenile Court Jurisdiction

Jurisdiction over persons less than 21 years old and accused of crime committed when less than 18 years old, jurisdiction can continue until defendant reaches 21 years old.

No juvenile court jurisdiction over any person accused of murder or attempted murder; or person 16+ accused of sexual assault or attempted sexual assault and previously convicted of any felony; or, person 16+ and accused of any offense involving the use or threatened use of a firearm and previously convicted of a felony; or, any offense where juvenile has previously been convicted of a criminal offense. ( 62B-330)

Prosecutor may move to transfer a case to adult court where juvenile was 14+ at time of conduct and accused of a felony (62B.390(1)), or 14+ at time of an alleged escape or attempted escape from juvenile custody ( 62B.400).

Upon motion by prosecution, court must transfer any case where factors set forth in 62B.390(2) are deemed true, but shall not transfer a case where court finds factors set forth in 62B.390(3) are true.
