NEW HAMPSHIRE JUVENILE COURT ATTORNEY
Juvenile Court Jurisdiction
Jurisdiction over persons less than 18 years old and accused of crime committed when less than 17 years old, jurisdiction can continue until defendant reaches 21 years old. ( 169-B:4).
Any juvenile accused of a felony may be transferred to adult court; court must hold a hearing and consider the factors set forth in 169-B:24(I)(a)-(h). Presumption that factors support transfer if juvenile is accused of a serious violent felony listed at 169-B:24(IV), or if juvenile is15 or older and has 4 or more prior convictions. ( 169-B:24)
Any juvenile transferred to adult court pursuant to 169-B:24 shall henceforth be treated as an adult.
Prosecutor may move juvenile court for leave to file a juvenile case directly in adult court where juvenile is accused of a felony and is outside the state. ( 169-B:25).
