Statutory Rape & Child Molestation 

• 632-A:2 Aggravated Felonious Sexual Assault Any person who engages in sexual penetration with any person under 13; or, any person engages in sexual penetration with a person 13 or older but under 16 and defendant is a member of the same household of victim or related to victim; or, any person engages in sexual penetration with a person 13 or older but under 18 and defendant is in a position of authority and uses the position of authority to coerce victim to submit; or, person intentionally touches the genitalia of a person under 13 with intent to arouse. (Class A Felony).
• 632-A:3 Felonious Sexual Assault Any person who engages in sexual contact under any of the circumstances set forth in 632-A:2 and in so doing causes serious personal injury to the victim; or, any person who engages in sexual penetration with a person 13 or older but under 16; or, any person who engages in sexual contact with a person under 13. (Class B Felony).
• 632-A:4 Sexual Assault Any person who engages in sexual contact under any of the circumstances set forth in 632-A:2; or, any person who engages in sexual contact with a person 13 or older but under 16 and where the defendant is 5 or more years older than victim; or, any person who engages in sexual penetration with a person 13 or older but under 16 and where the defendant is 3 years or less older than victim. (Class A Misdemeanor).
