NORTH CAROLINA JUVENILE COURT ATTORNEY
Juvenile Court Jurisdiction
Jurisdiction over persons less than 16 years old when alleged crime was committed. ( 7B-1601 & 7B1501(7)). No person 18 or older can be tried in juvenile court. ( 7B-1601(d)) Where allegation is that a person 18+ committed an offense prior to his 16th birthday, juvenile court has jurisdiction only to transfer the case to adult court, or to dismiss the petition.
Juvenile court may, on own motion or on motion of prosecutor, transfer any juvenile 13+ at time of alleged conduct constituting a felony to adult court. Court must transfer any juvenile 13+ at time of conduct constituting a Class A felony. ( 7B-2200).
Prior to transferring any juvenile to adult court, juvenile court must conduct a hearing and find probable cause as to the allegations, and consider the factors listed at 7B-2203.
