NORTH DAKOTA EXPUNGEMENT CRITERIA

There is no statutory process for sealing arrest records. A court may expunge an unconstitutional arrest if the arrestee has not been subsequently acquitted.

Adult convictions cannot be sealed. Records of juvenile delinquency adjudications are destroyed after 10 years. If the petition is dismissed, the record will be destroyed 1 year after the person turns 18 or is released from supervision, whichever occurs later.
