Juvenile Court Jurisdiction
Jurisdiction over persons less than 18 years old when alleged crime was committed, ( 27-20-03 & 27-20-02), except that no juvenile court jurisdiction over person 20+ unless state intentionally delayed case in order to move the case to adult court. ( 27-20-34(8)).
Juvenile court must transfer to adult court any juvenile 14+ at time of alleged conduct constituting a serious felony listed at 27-20-34(1)(b). Court must conduct a transfer hearing regarding any juvenile 14+ at time of conduct. ( 27-20-34(1)(c)). If juvenile court considers the factors listed at 27-20-34(3), and makes findings as required at 27-20-34(1)(c)(4), court must transfer the case to adult court.
