OKLAHOMA JUVENILE COURT ATTORNEY
Juvenile Court Jurisdiction
Juvenile Court jurisdiction over persons less than 18 years old, or within 90 days of 18th birthday, when case filed. ( 10-7303-4.3; 10-7303-1.2). Jurisdiction may not be retained past 19th birthday (10-7303-1.2).
No juvenile court jurisdiction over juvenile 13+ charged with first degree murder, or over juvenile 16+ and charged with a serious felony listed at 10-7306-1.1(A). ( 10-7301-1.3) In these cases juvenile may file a motion to be certified back to juvenile court, adult court must consider factors listed at 10-7306-1.1(E)(1)-(4).
After a preliminary inquiry in juvenile court, any juvenile 15+ and charged with a serious felony listed at 10-7306-2.6(A)(1)-(12) may, at discretion of prosecutor, be charged as an adult; same for juvenile 16+ and charged with a serious felony listed at 10-7306-2.6(B)(1)-(9).
Juvenile court may, with or without motion by prosecutor, transfer any juvenile charged with a felony to adult court. ( 10-7303-4.3(B). Prior to transferring to adult court, juvenile court must consider factors listed at 10-7303-4.3(B)(1)-(7).
