Statutory Rape & Child Molestation

• 21-111; 21-111.1; 21-1114 Rape in First Degree Any person 18+ who engages in vaginal intercourse or anal intercourse with any person under 14; or, vaginal or anal penetration not amounting to intercourse with person under 14. (Felony, punishable not less than 5 years to death sentence.)
• 21-111; 21-111.1; 21-1116 Rape in Second Degree Any person 18+ who engages in vaginal intercourse or anal intercourse with any person at least 14 but under 16; or, vaginal or anal penetration not amounting to intercourse with person at least 14 but under 16. (Felony, punishable not less than 1 year to 15 years max.)
• 21-1123 Lewd Proposal or Act as to Child Under 16 Any person who makes a lewd or indecent proposal to a person under 16, or to a person the defendant believes to be under 16, and where defendant is 3+ years older than victim; or, any person who commits a lewd act upon or in the presence of a person under 16 and where defendant is 3+ years older than victim; or any person who requires a person under 16 to view obscene or pornographic material and where defendant is 3+ years older than victim. (Felony punishable not less than 1 year to 20 year max.).
