Juvenile Court Jurisdiction
Juvenile Court has jurisdiction over persons less than 18 years old when case is filed. ( 419A.004; 419C.005). Jurisdiction may not be retained past 25th birthday (419C.005).
No juvenile court jurisdiction over juvenile 15+ charged with a serious felony listed at 137.707. In these cases case must be direct filed in adult court.
After hearing any juvenile 15+ at time of offense and charged with a serious felony listed at 419C.349(2)-(3) may be waived to adult court. Court must consider factors listed at 419C.349(4).
After hearing any juvenile less than 15 at time of offense and charged with a serious felony listed at 419C.352(3) may be waived to adult court. Court must consider factors listed at 419C.349(4).
