  • 3126 Indecent Assault Any person who engages in indecent contact with any person under 13 (First Degree Misdemeanor); or, any person who engages indecent contact with a person under 16 and where defendant is 4+ years older than victim. (Second Degree Misdemeanor)
  • 3102 Affirmative Defense Where criminality depends on the child being below a critical age older than 14 years, it is a defense for defendant to prove to a preponderance that he reasonably believed the child to be above the critical age.
