Our client, a college student under age 21, was at a concert on campus with her friend. Our client had been drinking, and when standing in the parking lot behind her friend’s car, an officer approached her and asked to see her identification. Our client’s friend gave the officer a fake ID and the officer got upset, then found some beer in the back seat of the car. Our client was asked to submit to a breath test, and after reading .02, the officer charged her with Minor in Possession of Alcohol. Our client was very concerned with keeping a clean record because she was in college to become a nurse and any charges could end her chances to get into nursing school.
