SOUTH DAKOTA JUVENILE COURT ATTORNEY
Juvenile Court Jurisdiction
Juvenile Court has jurisdiction over persons less than 18 years old when alleged conduct occurred; but no jurisdiction over person 21+ regardless of age at time of conduct. Jurisdiction may not be retained past 21st birthday ( 26-7A-1(6)).
Juvenile 16+ and charged with a serious violent felony listed at 26-11-3.1 must be direct filed in adult court. In such a case juvenile may request a hearing in adult court seeking transfer to juvenile court. Court must consider factors listed at 26-11-4.
