Juvenile Court Jurisdiction
Juvenile Court has jurisdiction over persons less than 18 years old when alleged conduct occurred; but no jurisdiction after 21st birthday regardless of age when conduct occurred. ( 78-3a-104)
No juvenile court jurisdiction over juvenile 16+ and charged with a serious felony listed at 78-3a-601(1)(a)-(b). These cases must be filed in adult court.
Juvenile court must transfer to adult court a juvenile 16+ and accused of a serious youth offender crime, listed at 78-3a-602(1)(a)(i)-(ix) if, after hearing, state meets burden to establish probable cause and juvenile cannot meet burden to establish mitigating factors listed at 78-3a-602(3)(b)(i)-(iii).
Juvenile court must conduct a preliminary hearing regarding any juvenile accused of a felony. Juvenile court may transfer to adult court if, after considering factors listed at 78-3a-603(3)(a)-(j), it makes findings listed at 78-3a-603(2)(a)-(b).
If a juvenile is transferred to adult court pursuant to either of the above procedures, such transfer is immediately appealable. (78-3a-604).
