Juvenile Court Jurisdiction
Juvenile Court has jurisdiction over persons less than 18 years old when the alleged conduct occurred. ( 16.1-288; 16.1-241).
Where juvenile is 14 years or older and is charged with a serious felony listed at 16.1-269.1(B)-(C), then the court must conduct a probable cause hearing and if PC is found, the court must transfer the case to adult court.
Where juvenile is14 years or older and is charged with any felony prosecutor may move to transfer the case to adult court. Court must hold a hearing and consider factors listed at 16.1-269.1(A)(4)(a)-(j). The court has discretion to retain or transfer the case, but if the case is transferred, court must make findings listed at 16.1-269.1(A)(1)-(4).
Juvenile court has no jurisdiction over any juvenile previously transferred to adult court. ( 16.1-271).
Any transfer of juvenile to adult court is immediately appealable. ( 16.1-269.4).
