Sex Crimes Involving Victims that are Minors
Statutory Rape & Child Molestation
- 18.2-67.3 Aggravated Sexual Battery Any person who engages in sexual abuse (defined in 18.2-67.10(6) as any contact with intimate parts of body or of clothing covering those parts) with any person under 13 years old; or, any person who engages in sexual abuse with a person at least 13 but under 18 and where defendant is the parent, grandparent, or step parent or grandparent of the victim. (Punishable by 1 to 20 years).
- 18.2-63 Carnal Knowledge of a Child Between 15 and 13 Any person who carnally knows (defined in section 18.2-63 as sexual intercourse, oral sex, anal sex or inanimate penetration) with any person at least 13 but under 15 years old (Class 4 felony); or, if victim consents and defendant is a minor and 3 or more years older than victim (Class 6 felony); or, if defendant is less than 3 years older than victim (Class 4 Misdemeanor.).
- 18.2-67.2 Object Sexual Penetration Any person who causes vaginal or anal penetration with an object of any person under 13 years old. (Punishable by 5 years to Life).
- 18.2-66 Effect of Subsequent Marriage to Child over 14 Any person who carnally knows a person 14+ with consent of the victim and who subsequently marries the victim and is living with that victim as husband and wife, may so plead as a defense. If court finds these facts true, it must continue the case until the victim reaches 16, if the defendant has not deserted the victim prior to the 16th birthday then the court shall dismiss the case.
