  • 9A.44.073 Rape of Child in First Degree Any person who engages in sexual intercourse with any person under 12 years old and where defendant is at least 24 months older than victim. (Class A Felony).
  • 9A.44.076 Rape of Child in Second Degree Any person who engages in sexual intercourse with any person at least 14 but less than 16 years old and where defendant is at least 48 months older than victim. (Class C Felony).
  • 9A.44.079 Rape of Child in Third Degree Any person who engages in sexual intercourse with any person at least 12 but less than 14 years old and where defendant is at least 36 months older than victim. (Class A Felony).
  • 9A.44.083 Child Molestation in First Degree Any person who engages in sexual contact with any person under 12 years old and where defendant is at least 36 months older than victim. (Class A Felony). .
  • 9A.44.086 Child Molestation in Second Degree Any person who engages in sexual contact with any person at least 12 but less than 14 years old and where defendant is at least 36 months older than victim. (Class B Felony).
  • 9A.44.083 Child Molestation in Third Degree Any person who engages in sexual contact with any person at least 14 but less than 16 years old and where defendant is at least 48 months older than victim. (Class C Felony).
  • 9A.44.093 Sexual Misconduct with a Minor in First Degree Any person who engages in sexual intercourse with any person at least 16 but less than 18 years old and where defendant is at least 36 months older than victim and is in a position of authority regarding victim and abuses that position. (Class C Felony).
  • 9A.44.096 Sexual Misconduct with a Minor in Second Degree Any person who engages in sexual contact with any person at least 16 but less than 18 years old and where defendant is at least 60 months older than victim and is in a position of authority regarding victim and abuses that position. (Gross Misdemeanor.).
  • Affirmative Defenses as to Victims Age Generally, mistake as to age is not a defense to any of the above charges. However, under very specific circumstances, listed at 9A.44.030(3)(a)-(h), reasonable mistake as to age is a defense if victim misrepresented age.
