WEST VIRGINIA JUVENILE COURT ATTORNEY
Juvenile Court Jurisdiction
Juvenile Court has jurisdiction over persons less than 19 years old and accused of a crime committed when defendant was under 18 years old. ( 49-5-2(b)).
Prosecutor may request a transfer hearing for a juvenile where grounds exist to justify transfer. ( 49-5-10(a)). Court must transfer a juvenile 14 years old or older where there is probable cause that the juvenile committed a crime listed at 49-5-10(d)(1)-(3). Court has discretion to transfer a juvenile under 14 and accused of a crime listed at 49-5-10(e)-(f). Court may transfer a juvenile 14 years old or older where factors listed at 49-5-10(g)(1)-(5).
