Statutory Rape & Child Molestation

• 6-2-303 Sexual Assault in the Second Degree Any person who engages in sexual intrusion with any person less than 12 years old where defendant is 4+ years older than the victim; or, any person who engages in sexual intrusion with any person where the defendant is in a position of authority with respect to victim and uses this authority to cause the victim to submit. (Felony punishable by up to 20 years).
• 6-2-304 Sexual Assault in the Third Degree Any person who engages in sexual intrusion with any person less than 16 years old where defendant is 4+ years older than the victim; or, any person 18+ who engages in sexual contact with any person under 14. (Felony punishable by up to 15 years).
• Affirmative Defense No defense for mistake as to age if criminality depends on victim being under 12 or 14 years old. Reasonable mistake as to age is a defense for charges where criminality depends on victim being under 16.
